These Terms of Service (“Terms”) govern your access to and use of the PK Business Services website, client portal, online systems, and services provided by PK Business Services (“PK Business Services,” “we,” “us,” or “our”).

By accessing our website, creating an account, submitting a service request, uploading documents, purchasing Services, or otherwise using our Services, you acknowledge that you have read and agree to these Terms.

1. Description of Services

PK Business Services provides business-support and administrative services that may include, depending on the services selected:

  • Bookkeeping support
  • QuickBooks and accounting-system cleanup
  • Accounting and bookkeeping organization
  • Inventory tracking and inventory-support services
  • Business administrative support
  • Document organization
  • Income verification and related documentation services
  • Business record organization
  • Reporting and administrative assistance
  • Other business-support services described on our website or in an individual service agreement

Specific Services, deliverables, deadlines, fees, and client responsibilities may be established through an order, proposal, engagement letter, service agreement, invoice, or other written communication.

2. No Guarantee of Results

PK Business Services will make reasonable efforts to provide Services in accordance with the applicable service description or agreement.

However, we do not guarantee any particular financial, business, tax, lending, employment, governmental, approval, funding, credit, or other outcome unless expressly stated in a written agreement.

Results may depend on information supplied by the client, third parties, government agencies, financial institutions, software platforms, and other factors outside our control.

3. Client Responsibilities

Clients are responsible for:

  • Providing accurate and complete information
  • Providing documents and records reasonably necessary to perform the Services
  • Reviewing information submitted on their behalf
  • Promptly responding to reasonable requests for information
  • Maintaining appropriate access to their own accounts and records
  • Informing PK Business Services of material changes affecting the requested Services
  • Ensuring that information supplied to PK Business Services is truthful and accurate

PK Business Services may rely on information provided by the client unless circumstances reasonably indicate that additional verification is necessary.

4. Accuracy of Client Information

You agree not to knowingly provide false, misleading, fraudulent, altered, or materially incomplete information.

PK Business Services may decline, suspend, or terminate Services when information provided appears inaccurate, fraudulent, unlawful, or inconsistent with the requested Service.

We may request additional documentation when reasonably necessary to complete a service request.

5. Client Portal and Accounts

Certain Services may require the creation of a client portal account.

You are responsible for maintaining the confidentiality of your login credentials and for activity occurring through your account.

You agree to notify PK Business Services promptly if you believe your account has been compromised or accessed without authorization.

PK Business Services may suspend or restrict access to an account when reasonably necessary for security, fraud prevention, maintenance, or enforcement of these Terms.

6. Document Uploads

Clients may be permitted to upload documents through the client portal.

You represent that you have the right to provide documents and information uploaded to the portal and that doing so does not knowingly violate another person's rights or applicable law.

Clients should upload only documents reasonably necessary for the requested Service.

7. Fees and Payment

Fees for Services will be communicated through the applicable service description, proposal, invoice, order, or agreement.

Available payment methods may include third-party payment services such as:

  • Stripe
  • Cash App
  • Zelle
  • Other payment methods made available by PK Business Services

Third-party payment providers may impose their own terms, fees, restrictions, verification requirements, or processing policies.

Unless otherwise stated in writing, payment does not guarantee a particular result or outcome.

8. Refunds and Cancellations

Refund eligibility, cancellation rights, deposits, and other payment terms may depend on the particular Service purchased and any applicable service agreement.

Unless otherwise required by applicable law or expressly stated in writing, fees for Services already performed may not be refundable.

PK Business Services reserves the right to establish service-specific cancellation and refund policies.

9. Service Delays

PK Business Services will make reasonable efforts to meet stated deadlines.

However, completion dates may depend on:

  • Client responsiveness
  • Receipt of required documents
  • Third-party systems
  • Software availability
  • Payment processing
  • Government or financial institution processing
  • Unexpected technical issues
  • Other circumstances outside our reasonable control

PK Business Services is not responsible for delays caused by information or actions outside our control.

10. Professional and Regulatory Limitations

PK Business Services provides the Services described in applicable service materials and agreements.

Unless expressly stated and legally authorized, PK Business Services does not represent itself as providing legal advice, legal representation, investment advice, lending decisions, credit decisions, or other regulated professional services.

Where a matter requires a licensed attorney, CPA, enrolled agent, financial professional, or other regulated professional, clients may be advised to seek assistance from an appropriately qualified professional.

11. Income Verification and Documentation Services

Where PK Business Services provides income verification, income documentation, business verification, or related administrative services, such Services are based on information and documentation provided by the client or otherwise legitimately obtained.

PK Business Services does not guarantee that a third party, lender, landlord, employer, governmental agency, financial institution, or other organization will accept or approve documentation produced through the Services.

PK Business Services does not knowingly create, alter, fabricate, or misrepresent financial information or supporting documentation.

Clients are responsible for the accuracy and legitimacy of information they provide.

12. Prohibited Uses

You may not use the Services to:

  • Commit or facilitate fraud
  • Submit knowingly false information
  • Create fraudulent financial or business records
  • Impersonate another person or business
  • Circumvent security measures
  • Gain unauthorized access to accounts or systems
  • Upload malicious software
  • Violate applicable law
  • Infringe intellectual-property rights
  • Interfere with the operation or security of the Services
  • Use the Services for any unlawful purpose

PK Business Services may refuse or terminate Services when we reasonably believe the Services are being used for prohibited purposes.

13. Intellectual Property

Unless otherwise stated, the PK Business Services website, branding, logos, graphics, original content, systems, processes, software interfaces, templates, and other materials provided by PK Business Services are owned by or licensed to PK Business Services and may be protected by applicable intellectual-property laws.

You may not copy, reproduce, distribute, modify, sell, or commercially exploit PK Business Services materials without permission, except as permitted by law or an applicable agreement.

Client-owned documents and information remain the property of the client or their respective owners.

14. Confidentiality

PK Business Services will treat client information as confidential and will use it primarily for purposes related to providing the requested Services, operating the business, complying with legal obligations, and otherwise as described in our Privacy Policy or applicable agreement.

Additional confidentiality obligations may be established through an engagement letter, service agreement, nondisclosure agreement, or other written contract.

15. Third-Party Services

The Services may depend on third-party platforms, including accounting software, payment processors, cloud-storage systems, communications services, authentication providers, or other technology.

PK Business Services does not control third-party services and is not responsible for outages, changes, errors, policies, security incidents, or other issues caused by third-party providers, except to the extent required by applicable law.

16. Communications

By creating an account, submitting a service request, or providing contact information, you agree that PK Business Services may contact you regarding your account, requested Services, payments, documents, scheduling, security, and other business-related matters.

Marketing communications, where applicable, may provide an option to unsubscribe.

17. Suspension and Termination

PK Business Services may suspend or terminate access to Services when reasonably necessary, including for:

  • Nonpayment
  • Violation of these Terms
  • Fraudulent or unlawful activity
  • Security concerns
  • Abuse of personnel or systems
  • Providing materially false information
  • Operational or business reasons

Termination does not eliminate obligations that accrued before termination.

18. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services and website are provided without warranties except those expressly stated in a written agreement.

PK Business Services does not warrant that:

  • The website or portal will always be available
  • Services will be uninterrupted or error-free
  • Information supplied by clients or third parties will be accurate
  • Third-party systems will remain available
  • A particular business, financial, tax, lending, employment, funding, or other result will occur

Nothing in these Terms is intended to exclude a warranty or right that cannot legally be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, PK Business Services will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Services, website, portal, third-party services, or these Terms.

Any additional limitations of liability, exclusions, or monetary caps may be included in a service-specific agreement where appropriate.

Nothing in these Terms limits liability that cannot legally be limited.

20. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims, losses, liabilities, damages, and expenses arising from your unlawful use of the Services, violation of these Terms, or knowing submission of false, fraudulent, or unauthorized information.

The scope of this provision is subject to applicable law.

21. Dispute Resolution

Before initiating formal legal proceedings concerning a dispute related to the Services, the parties are encouraged to attempt in good faith to resolve the matter directly.

Any additional requirements concerning mediation, arbitration, venue, jurisdiction, governing law, attorney fees, or class-action procedures may be established in a service-specific agreement where appropriate.

22. Governing Law

These Terms will be governed by applicable law, without regard to conflict-of-law principles, except where applicable law requires otherwise.

23. Changes to These Terms

PK Business Services may update these Terms from time to time.

When material changes are made, PK Business Services may update the Effective Date and provide additional notice when appropriate.

Continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.

24. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.

25. Entire Agreement

These Terms, together with applicable service agreements, engagement letters, invoices, proposals, policies, and other written agreements incorporated by reference, constitute the agreement governing your use of the applicable Services.

If a service-specific written agreement conflicts with these Terms, the service-specific agreement will control to the extent stated in that agreement.
